How to Organize Annual General Meeting Invitation and Using Votes ?

To organize annual general meeting you should follow the Turkish Condominium Law, certain procedures must be followed regarding the scheduling and management of condominium meetings to ensure proper representation and decision-making.

Firstly to organize annual general meeting, the law mandates that all condominium unit owners must receive written invitations to the meeting at least 15 days before the scheduled date. Each invitation should list two potential meeting dates. Importantly, these two proposed dates must be spaced at least 7 days apart to accommodate various scheduling preferences and conflicts.

For the initial meeting, the presence of at least 50% plus one of the total number of units in the condominium is required to achieve a quorum. If this quorum is not met on the first proposed date, the meeting can proceed on the second date without the need to reach the same quorum threshold.

In terms of representation, the law allows unit owners, tenants, and other adults to use proxies, or power of attorney, to vote on their behalf. The number of proxies permitted is limited to ensure fair representation. Specifically, in a condominium complex with up to 100 units, no more than 5 proxies are allowed. For complexes with fewer than 40 units, the maximum number of proxies is restricted to 2. Therefore, as an owner of an apartment, you are entitled to vote in person and can also hold proxies for up to 5% of the total number of units in the complex, as long as the total number of proxies does not exceed the legally prescribed limit.

This system is designed to balance the need for sufficient attendance with the practicalities of individual owners’ availability, while ensuring that decisions reflect a broad consensus within the condominium community.
